Objectives

  1. Discuss and demonstrate a general understanding of our judicial system and how laws are made and relate how individuals from fire service organizations can benefit from the knowledge.
  2. Identify the considerations, potential risks and possible mitigations of legal action against fire organizations.
  3. Describe potential civil liabilities and possible criminal actions against fire and emergency service organizations.
  4. Explain criminal law and the fact that firefighters and EMS personnel are responsible for their own criminal acts.
  5. Identify and discuss the potential liability and avoidance of such liability in your fire and emergency service organization.
  6. Examine the scope of the civil rights acts and discuss areas of potential discrimination that directly affect fire service organizations.
  7. Describe the potential discrimination liabilities for fire and emergency service organizations.
  8. Evaluate the Americans with Disabilities Act and describe the areas of potential liabilities under the Americans with Disabilities Act that fire service organizations face.
  9. Identify the principles common to most workers’ compensation systems and know where to get information about your state’s workers’ compensation program.
  10. Compare the requirements of the Fair Labor Standards Act (FLSA) and how the Act applies to fire service organizations including a discussion of the wage and hour provisions of FLSA.
  11. Analyze the requirements of Family and Medical Leave Act (FLMA).
  12. Summarize the Occupational Safety and Health Act and discuss the impact of safety and health regulations on fire and emergency service organizations.
  13. Discuss fully the Age Discrimination Employment Act (ADEA) to include the parameters and requirements set forth by the act and describe methods of avoiding age discrimination within a fire service organization.
  14. Describe how the various federal and state labor and employment laws impact your fire service organization.
  15. Explain the collective bargaining process and describe how the process is governed and describe individual rights and responsibilities in the collective bargaining process and how a fire service organization is affected in the process.
